My Shout Competition Terms
Version 0.1 (draft), 26 September 2026
These Competition Terms set out how the My Shout daily draws, spot prizes, skill prizes and prizes work. They apply together with the My Shout Terms of Use and the My Shout Privacy Policy. Every draw also has a Schedule (see Part D) that states that draw's region, prizes, values, sponsors, expiry and draw time. The Schedule for a draw is fixed before that draw opens and does not change.
The short version
- Promoter: NetPotential Limited, trading as Growth Spurt, Auckland. Not the sponsors, and not Shona.
- Free to enter. No purchase, no payment, no paid entries, no paid bonus entries, ever. A standard text to log in is the only cost, and it goes to your carrier, not to us. A free alternative to texting is available.
- Who: New Zealand residents aged 18 or over, one player per verified NZ mobile number, one account each.
- How: finish the Anytime Quiz and you have 1 entry in tonight's draw for your home region. Play the 21:00 Live Game and you earn 1 entry for every correct answer, up to 12. Entries are for your home region only.
- When: entries close and the list is sealed when the Live Game ends (about 21:05). The draw runs a few minutes after the seal, live in the app.
- How winners are picked: the sealed entry list is published in a form that identifies nobody, submitted to public timestamping, and the winners are chosen from it using the League of Entropy public randomness beacon. Anyone can check any draw with the verifier we publish. Every entry has an equal chance. A person can win at most one prize per draw.
- Prizes are supplied by the local sponsor named in the Schedule, redeemed in person with a unique code, and are not exchangeable for cash. No alcohol or tobacco prizes.
- Winners are notified by text, push or in the app, must claim within the claim window, and redeem before the prize expires (at least 60 days). Unclaimed prizes are redrawn from the same sealed list.
- Fair play: bots, extra accounts, borrowed numbers and region spoofing void your entries.
- The rules for a draw never change after it opens. If the randomness beacon is unavailable we use a later round, in a way fixed in advance and published, and we never quietly re-run a draw.
This summary is a guide. The numbered clauses below are the rules.
Part A: The competition
1. Promoter and structure
1.1 The promoter of every My Shout draw and prize is NetPotential Limited, trading as Growth Spurt (company number [insert], NZBN [insert]), of [insert address], Auckland, New Zealand (we, us, our, the Promoter). Sponsors supply prizes and Deals but are not promoters. Shona, our AI host, is software operated by us and is not the promoter and has no authority to change these terms.
1.2 Each daily draw for a region is a separate competition (a Draw). A Draw is governed by:
(a) these Competition Terms;
(b) the Schedule published for that Draw; and
(c) the Terms of Use and the Privacy Policy.
If there is a conflict, the Schedule prevails for that Draw, then these Competition Terms, then the Terms of Use.
1.3 A Draw opens when the previous Draw for that region has been drawn and its entry list published (normally a few minutes after 21:00 New Zealand time). A Draw closes when its entry list is sealed under clause 7. The version of these Competition Terms and the Schedule in force when a Draw opens govern that Draw and are not changed for that Draw (clause 19).
1.4 Entry is free. No purchase or payment is necessary to enter, to earn any entry, or to win. We never sell entries, bonus entries or improved chances, and we will never accept payment for them. If a purchase were ever required, the competition would be unlawful gambling under the Gambling Act 2003, so this rule is absolute.
1.5 Words defined in the Terms of Use have the same meaning here. NZ time means the time in Auckland, New Zealand (NZST or NZDT as applicable).
2. Who can enter
2.1 You can enter a Draw if, at the time you enter and at the time the Draw is sealed, you:
(a) are 18 years of age or older;
(b) are a resident of New Zealand;
(c) hold a My Shout account with a verified New Zealand mobile number that is yours or under your lawful control;
(d) have set the Draw's region as your home region under clause 5; and
(e) are not excluded under clause 2.2.
2.2 The following people cannot win a prize, and any entry they make is void:
(a) our directors, employees and contractors, the directors and employees of our related companies, and the immediate family (spouse, partner, parent, child, sibling) and household members of any of them; and
(b) for any prize supplied by a particular Sponsor, that Sponsor's owners, directors, employees and their immediate family and household members.
2.3 We may ask a winner for reasonable proof of age, identity, residency or number ownership before a prize is released. If you cannot provide it within the claim window, the prize is treated as unclaimed under clause 12.
2.4 Only individuals can enter. Businesses, groups, syndicates and automated agents cannot.
3. How to enter
3.1 There are two ways to earn entries into a Draw. Both are free. The number of entries available from each is stated in the Schedule for the Draw. Unless the Schedule says otherwise:
(a) Anytime Quiz. Finish the day's Anytime Quiz for your home region at any time between the opening of the Draw and the start of the Live Game, and you earn 1 entry. You must answer every question to finish. Your score does not affect the entry. You can play the Anytime Quiz once per Draw.
(b) Live Game. Play the Live Game for your home region at 21:00 NZ time and you earn 1 entry for each question you answer correctly within that question's time window, up to a maximum of 12 entries. The Live Game has 12 questions, each shown to all players at the same moment, and each with a time limit shown on screen.
3.2 Whether entries from the Anytime Quiz and the Live Game are added together, or whether the Live Game replaces the Anytime Quiz entry, is stated in the Schedule. The default is that they are added together (a maximum of 13 entries per player per Draw).
3.3 Every entry in a Draw has exactly the same chance of being selected. No entry is weighted. Playing more skilfully earns more entries in the Live Game; it does not change the chance of any single entry.
3.4 An entry is recorded only when our server receives your completed Anytime Quiz, or your answer to a Live Game question, before the relevant window closes by the server's clock. Our server's clock and records are the authoritative record of when a quiz was finished or an answer was received. The Live Game applies a latency compensation of up to 150 milliseconds; beyond that, a late answer is a late answer.
3.5 The Live Game is played live. Questions are not available before 21:00 and are not replayed. If you connect late, lose your connection, or your device sleeps, you can rejoin and answer the questions still open, but you cannot answer questions whose window has closed. We do not give replacement entries for connection, device, browser, notification or app-installation problems, wherever the cause lies, except where clause 18 applies.
3.6 You play once per Draw: one Anytime Quiz and one Live Game per account per region per day. Entries are personal to you and cannot be transferred.
3.7 Bonus entries. From time to time the Schedule may state that additional free entries can be earned in a specified way (for example, a streak of daily play). Bonus entries exist only if the Schedule for that Draw says so, are always free, are counted in the entry totals and odds shown to players, and are capped as the Schedule states. There is always a way to enter with the same base chance that does not involve any bonus mechanism.
Note for the lawyer: before any bonus entry mechanism is enabled (streaks, referral bonuses, invitation tickets or team unlocks), please advise whether the effort or the referral of another person could be treated as indirect consideration under section 4 of the Gambling Act 2003, and whether the wording of this clause should change to reflect your advice. No bonus mechanism will be switched on before this advice is received.
3.8 Cost of entry. You pay nothing to us. Sending a login text costs you your carrier's standard rate for one text message; we do not use premium numbers and receive no part of that charge. If you do not want to send a text, contact us at [contact email] and we will verify you free of charge by another method (Terms of Use clause 3.3). Your own device and data costs are yours.
Note for the lawyer: please confirm that a standard-rate carrier charge for a login text, paid to the telco and not to the Promoter, is not "consideration" for the purposes of section 4 of the Gambling Act 2003, and whether the free alternative in this clause is necessary or advisable.

Note for the lawyer: please confirm that because entry is free, this competition is not "gambling" under section 4 of the Gambling Act 2003, is not a "sales promotion scheme" (which requires a purchase), and that entries earned per correct answer in the Live Game (a skill element) do not change that analysis. Also confirm no other licence, permit or registration is required for a platform running free draws whose prizes are supplied by third-party sponsors.
4. Odds and entry counts
4.1 We show the number of entries and players in a region, and the resulting chance of winning ("1 in 43 right now"), as live figures. They are calculated from entries counted at that moment and change as people play. The final chance of winning is set only when the entry list is sealed, and the sealed entry count is published with the Draw.
4.2 Displayed entry counts include every entry of every kind, including any bonus entries. We do not display invented counts, invented winners or invented testimonials.
5. Regions and your home region
5.1 Each Draw is for one region. Regions are listed on the site and may include, for example, Auckland North Shore, Auckland Central, Auckland East, Auckland South, Auckland West, Hamilton, Whangārei, Tauranga, Rotorua, Wellington, Christchurch, Dunedin and Queenstown. Regions may be added, split, merged or closed over time; a change takes effect only for Draws that open after the change.
5.2 You enter only the Draw for your home region. You choose your home region at sign-up and can change it once in any 30-day period. A change takes effect for the next Draw to open after you make it. Entries you have already earned in a Draw stay in that Draw.
5.3 Prizes are redeemed in person at the Sponsor's premises in the region of the Draw. We do not pay travel or other costs of redeeming a prize. Choosing a region where you cannot redeem is your risk.
5.4 We compare device, network and location signals with your home region. We do not void entries on location signals alone, but a pattern that suggests you have chosen a region you do not live in or visit, combined with other signals, may lead to review under clause 13.
6. Prizes
6.1 The prizes for a Draw, their stated value in New Zealand dollars including GST, the Sponsor of each prize, the redemption conditions, and the expiry date are set out in the Schedule for that Draw. Only prizes confirmed by their Sponsor before the Draw opens are listed and only listed prizes are drawn.
6.2 Unlock prizes. The Schedule may list a prize that is added to the Draw only if the region reaches a stated number of players before the Draw is sealed. An unlock prize is part of the Draw only if the condition is met before the seal; the sealed commitment lists which prizes are in the Draw. Unlock conditions never restrict who can enter or how, and a player is not required to invite or refer anyone to enter.
6.3 Sponsor as supplier. Each prize is supplied by the Sponsor named for it. The Sponsor is the supplier of the prize for the purposes of the Consumer Guarantees Act 1993 and the Fair Trading Act 1986, and the guarantees in the Consumer Guarantees Act (where they apply) run against the Sponsor. We arrange the prize and issue the redemption code; we do not manufacture, hold, deliver or provide the prize, and we are not the Sponsor's agent.
Note for the lawyer: please confirm our analysis that a prize of goods is a supply "by way of gift" by the Sponsor under section 2 of the Consumer Guarantees Act 1993, so the Sponsor is the supplier, and advise whether the Promoter could also be treated as a supplier of the prize or of the competition as a service. Our position is that we accept any non-excludable liability the law imposes on us and exclude everything else.
6.4 Prize conditions. A prize is subject to the Sponsor's conditions as stated in the Schedule, including any days or times it can be used, booking requirements, what it can and cannot be spent on, and whether it can be split over more than one visit. A prize is not exchangeable for cash, no change is given, and a prize cannot be transferred, sold or exchanged unless the Schedule says it can. A prize is a fixed item or a fixed value; if it is not fully used before it expires the balance lapses.
6.5 No alcohol, tobacco or vaping. No prize or Deal will consist of, include, or be redeemable for alcohol, tobacco products, vaping products or any regulated product under the Smokefree Environments and Regulated Products Act 1990, and no prize or Deal will be conditional on purchasing alcohol. A voucher for a licensed restaurant, bar or café cannot be used to pay for alcohol. This gives effect to section 237 of the Sale and Supply of Alcohol Act 2012 and the smokefree legislation. If a Sponsor attempts to provide alcohol or tobacco against a code, tell us.
6.6 Prize values. Stated values are the Sponsor's normal retail price at the date the Schedule is published. We do not represent that a prize has a resale value. Where a prize is a fixed dollar value at a Sponsor (for example "$100 to spend at [Sponsor]"), that is the value.
6.7 Substitution. We will not substitute a prize because we or a Sponsor would prefer to, and we never substitute a lesser prize. If a Sponsor is unable or unwilling to provide a prize as described (including because the Sponsor closes, is insolvent, or does not honour the code), we will provide the winner with a substitute prize of equal or greater stated value, which may be from a different Sponsor in the same region or, if no suitable prize is available, in another form we choose of equal or greater value. We will tell the winner why.
Note for the lawyer: section 17 of the Fair Trading Act 1986 makes it an offence to offer prizes with the intention of not providing them as offered. We propose to fund substitutes from a small reserve. Please advise whether an obligation to substitute "in another form of equal or greater value" is sufficient, whether the fallback should expressly include a cash payment of the stated value, and whether any qualifier such as "reasonable endeavours" would be acceptable or would weaken compliance.
6.8 One prize per person per Draw. A person can win at most one prize in a Draw. If the same person's entry is selected for a second prize in the same Draw, that selection is skipped under clause 8.5 and the prize is awarded to the next selected entry. The Schedule may also state a limit on the number of prizes one person can win in a rolling period (for example, one prize per 30 days per region); if so, a selected entry belonging to a player who has reached that limit is skipped in the same way. Any such limit is applied by the published selection code, not by our discretion.
6.9 Deals for all players. Sponsors also offer Deals to players in a region. Deals are not prizes, are not part of any Draw, are not required to enter, and are offered by the Sponsor on the Sponsor's conditions under the Terms of Use clause 6. Nothing in these Competition Terms makes a Deal a prize or makes us its supplier.
Part B: The draw
7. Sealing the entry list
7.1 At the time stated in the Schedule (normally at the end of the Live Game, a few minutes after 21:00 NZ time) entries for the Draw are frozen and the entry list is sealed. No entry can be added, removed or changed after the seal except that an entry can later be found void under clause 13, in which case a prize selected for it is dealt with under clause 12.
7.2 Sealing works as follows:
(a) each entry is converted into a cryptographic leaf: a SHA-256 hash of the draw identifier, the player's identifier, the entry number and a secret salt unique to the player, so that the list can be published without identifying anyone;
(b) the leaves are sorted and built into a Merkle tree, producing one Merkle root for the whole list;
(c) each entry is also tagged with a group identifier derived from the player's identifier and a per-Draw salt, so that the "one prize per person" rule can be checked by anyone without knowing who anyone is;
(d) we publish a commitment containing the draw identifier, the region, the ordered list of prizes, the number of entries, the Merkle root, the hash of the group identifiers and the randomness round to be used (clause 8.2), signed with our published My Shout signing key, to a public, append-only draw log at myshout.nz/draws; and
(e) at the same time we submit the commitment's hash to at least three independent OpenTimestamps calendar servers, which aggregate it for anchoring on the Bitcoin blockchain.
7.3 The commitment is published before the randomness round used for the Draw exists, so neither we nor anyone else can choose or change the entry list, the number of entries or the order of prizes once the winning number is known.
7.4 The Bitcoin confirmation of the OpenTimestamps proof usually arrives within hours of the Draw. It shows that the sealed list existed no later than that Bitcoin block. It is a permanent record made after the Draw; the proof that the list was fixed before the Draw is the signed, published commitment and the calendar receipts. We upgrade and publish the completed Bitcoin proof when it is available.
8. Selecting the winners
8.1 Winners are selected by a fixed, published method from the sealed entry list and a public random number that nobody, including us, can know in advance.
8.2 The random number is the output of the drand League of Entropy randomness beacon ("quicknet" chain, or its successor named in the Schedule), which is generated jointly by a group of independent organisations and published every few seconds. The commitment names a specific future round number R, being the round scheduled for the draw time in the Schedule, a few minutes after the seal.
8.3 When round R is published, our draw system fetches it from at least two independent relays, verifies the beacon's cryptographic signature against the beacon's published public key, and derives the randomness from the verified signature.
8.4 For each prize, in the order fixed in the commitment, the selection code computes a keyed hash (HMAC-SHA256) of the draw identifier, the prize position and an attempt counter, using the randomness as the key, and converts it into an entry index in a way that gives every entry exactly the same chance (rejection sampling, so there is no modulo bias). The entry at that index wins the prize.
8.5 If the selected entry belongs to a group that has already won a prize in this Draw (or that has reached a limit stated in the Schedule under clause 6.8), the selection is skipped and the attempt counter is increased until an eligible entry is selected. Every skip is recorded and published.
8.6 If there are more prizes in a Draw than eligible groups, remaining prizes are not awarded and return to their Sponsors, and we publish that.
8.7 Spot prizes during the Live Game (clause 10) and redraws for unclaimed prizes (clause 12.5) use the same method, with the round and inputs published as clause 10 and clause 12 describe.
8.8 Human sign-off. A person authorised by us confirms that the draw system ran correctly before winners are announced. That person cannot change the entry list, the prize order, the round or the result. If the person finds that the system did not run as described in these terms, clause 9 applies and we publish what happened.
9. If something goes wrong with the draw
9.1 Beacon round unavailable. If round R cannot be fetched from at least two relays, or its signature cannot be verified, within 15 minutes of its scheduled time, the Draw uses round R + 100 (about five minutes later on the quicknet chain) instead. If that round is also unavailable or unverifiable within 15 minutes, the Draw uses the next round that is a further 100 rounds later, and so on, until a verifiable round is obtained. Each substitution is published in the draw log with the reason. No other round is ever used.
9.2 Never re-run. A Draw is never re-run, re-seeded or re-sealed. The entry list, the entry count, the prize order and the rule for which round is used are fixed at the commitment. If a result is published and later found to be wrong because the published method was not followed, we will publish the correct result of the published method applied to the same commitment and the same round, together with an explanation. A prize awarded in error under the wrong result remains with the person to whom it was awarded, and the correct winner is also awarded the prize or a substitute of equal or greater value under clause 6.7.
9.3 Draw system failure. If our draw system cannot run at the scheduled time (for example, our hosting provider is unavailable), the Draw runs as soon as it can using the round named in the commitment (or the substitute round under clause 9.1 if that round cannot be verified). The drand beacon keeps producing rounds whether or not our system is online, so a delay in our system does not change the random number or the result.
9.4 Seal failure. If entries for a Draw cannot be sealed and committed at the scheduled time because of a failure in our systems, we will seal and commit them as soon as the system is restored, using the entries recorded before the scheduled seal time by the server's records, and the round R will be reset to a round after the actual commitment time. The draw log records the actual seal time. If the entry records themselves are lost or corrupted so that a list matching these terms cannot be sealed, the Draw is cancelled under clause 18 and its prizes are carried into the next Draw for that region.
9.5 Timestamping failure. If the OpenTimestamps calendars are unavailable at the seal, the Draw still proceeds on the signed commitment in the public log, and we submit the commitment for timestamping as soon as the calendars are available, publishing the actual submission time. Timestamping is a permanence measure; it is not what makes the Draw fair, and its delay does not affect the result.
9.6 Verifier and record. The signed commitment, the round used, the beacon signature, the selection steps (including skips), the winning entry indices and leaves, and any substitution under this clause, are published in the draw log. Where a published record and an on-screen announcement differ, the published record is correct.
10. Spot prizes in the Live Game
10.1 The Schedule may list spot prizes to be awarded during the Live Game. A spot prize is awarded at the point in the game stated in the Schedule (for example, after question 6), from among the players who at that moment are eligible under clause 2, connected to the Live Game for that region, and meet any condition stated in the Schedule (for example, answered the preceding question correctly).
10.2 A spot prize is selected using the same method as clause 8, applied to the list of eligible players at that moment (one entry per eligible player) and the most recent verified beacon round at the time of selection. The list, its hash, the round and the selection are published in the draw log after the Live Game. Because the eligible list is formed at that moment, spot prizes are not pre-committed in the same way as the main Draw; the published record and the verifier let anyone check that the winner was selected from the published list by the published round.
10.3 A player can win at most one spot prize per Live Game, and a spot prize does not count towards the one-prize-per-Draw limit of the main Draw unless the Schedule says so.
10.4 Spot prizes are prizes for all other purposes of these terms, including clauses 6, 11 and 12.
11. Skill and team prizes
11.1 The Schedule may list a prize awarded not by draw but by score (for example, a weekly prize for the highest Live Game score in a region) or by participation (for example, a prize for the suburb, school or workplace with the highest participation rate). These are skill prizes.
11.2 A skill prize is awarded according to the criteria and period stated in the Schedule. Only Live Game scores count towards score-based prizes, because Anytime Quiz answers are available during the day. Ties are broken in the order stated in the Schedule, and if the Schedule is silent, by the earliest total answer time across the period and then by the earliest completed game. Scores and rankings are computed by our systems from the per-question answer records, and the published leaderboard for the period is the record of the result.
11.3 A skill prize is a prize for all other purposes of these terms, including clauses 6, 12 and 13. Scores obtained in breach of the Terms of Use are removed and rankings are recalculated.
Part C: After the draw
12. Winners, claiming and redeeming
12.1 Announcement. Winners are announced in the app and on the draw record as anonymous entry leaves. A winner's name is published only with consent under clause 14.
12.2 Notification. We notify each winner by text message to the verified mobile number, by push notification (if enabled) and in My Account, normally within one hour of the Draw. It is your responsibility to keep your number current and to check My Account. Shona may also tell you that you have won, but the notification in My Account is the official notice.
12.3 Claiming. A winner must claim the prize in My Account within the claim window stated in the Schedule, which is at least 7 days from the notification. Claiming means confirming the claim in My Account, providing any information the Schedule reasonably requires (for example, a name for a booking), and, if we ask under clause 2.3, providing proof of eligibility. On a valid claim we issue a unique redemption code.
12.4 Redeeming. The winner presents the redemption code to the Sponsor in person and the Sponsor provides the prize on its conditions. Each code works once. A code must be redeemed before the expiry stated in the Schedule, which is at least 60 days after the code is issued. The person who redeems the code must be the winner, unless the Schedule allows transfer. Losing a code, letting someone else use it, or not using it before expiry are the winner's risk, except that we may reissue a code where we are satisfied it was not used.
12.5 Unclaimed prizes and redraws. If a prize is not claimed within the claim window, or a claim is invalid, or the winner's entry is found void under clause 13, the prize is redrawn from the same sealed entry list using the same method (clause 8), continuing the attempt counter from where the original selection stopped and using the same randomness, so that the redraw is as verifiable as the original. The redraw is published in the draw log with its reason. If the redrawn winner also fails to claim, one further redraw is made. After two redraws a prize that remains unclaimed lapses and returns to the Sponsor. A prize that is claimed but not redeemed before its expiry lapses and is not redrawn.
12.6 Sponsor unable to redeem. If a Sponsor refuses or is unable to honour a valid, unexpired code, tell us within 14 days of the attempt and clause 6.7 applies.
12.7 Prizes and the law. A prize is provided by the Sponsor subject to your rights under the Consumer Guarantees Act 1993, which cannot be excluded. Beyond those rights, and subject to clause 16, a prize is provided as described in the Schedule and without any other warranty from us.
13. Void entries, fraud and decisions
13.1 An entry is void, and any prize selected for it is withheld or (if already issued) cancelled, if we determine on reasonable grounds that:
(a) the entrant is not eligible under clause 2;
(b) the entry was made, or the account was created or operated, using bots, scripts, automation, emulators or any tool prohibited by the Terms of Use;
(c) the entrant holds or controls more than one account, or the account uses a mobile number that is not the entrant's or was obtained to create extra accounts;
(d) the entrant misrepresented their location or home region, including by VPN, proxy or spoofing;
(e) the entrant obtained, shared or coordinated answers during a quiz window, manipulated timing or latency, or exploited a bug;
(f) the entrant's conduct otherwise breached the Terms of Use, the Competition Terms or the law in a way connected with the entry; or
(g) the entry is otherwise fraudulent, or the prize claim is fraudulent.
13.2 Where an entry is found void after the seal, the leaf stays in the sealed list (the list cannot change) but the entry is treated as ineligible: any prize selected for it is redrawn under clause 12.5, and the reason is published without identifying the entrant.
13.3 We may suspend a prize while we investigate. Where practicable we will tell the entrant what we have found and give them a reasonable opportunity to respond before a final decision, and a person, not an automated system alone, makes the final decision to void.
13.4 Subject to clause 20 and to your rights under the law, our decisions on eligibility, on whether an entry is void and on the interpretation of these terms are final. Decisions about who has won are not ours to make: they are the output of the published method and can be checked by anyone.
13.5 We may recover from a person who obtained a prize by fraud or in breach of these terms the value of the prize and our reasonable costs of dealing with the matter, and we may report the matter to the Police.
14. Publicity and your privacy
14.1 We will ask each winner whether we may publish their first name and suburb or region, and, if they agree, use that information (and any photograph or quote they choose to give us) in our announcements, Shona's daily video and our social channels. Consent is optional, is not a condition of receiving a prize, can be withdrawn at any time for future use, and is recorded. We do not publish a winner's surname, mobile number, exact address or any other personal information.
14.2 We publish the anonymised draw record described in clause 9.6 for every Draw, permanently. It does not identify anyone. Your own proof of entry (your salt, leaf and Merkle path) is available to you in My Account and is not published by us.
14.3 We give a Sponsor the information needed to honour a redemption code (the code, the prize, and, where the Schedule requires a booking, the name you provide). We do not give a Sponsor your mobile number or other contact details for marketing unless you separately opt in.
14.4 The Privacy Policy explains everything else about how we handle your personal information, including your right to access and correct it under the Privacy Act 2020.
15. Tax
15.1 We do not give tax advice. Whether a prize has tax consequences for you depends on your circumstances. You are responsible for any tax that may apply to a prize you receive, and you should seek your own advice if you are unsure.
Note for the lawyer: please confirm the drafting. We are aware that prizes from a free competition are generally not income for an individual, but we have deliberately not stated that.
16. Liability
16.1 Nothing in these Competition Terms excludes, restricts or modifies any right or remedy you have under the Consumer Guarantees Act 1993, the Fair Trading Act 1986 or any other law that cannot be excluded, restricted or modified by agreement. Clause 14 of the Terms of Use applies.
16.2 Subject to clause 16.1, and to the maximum extent permitted by law:
(a) we are not liable for any prize or Deal, its quality, safety, fitness, description or availability, or for any act, omission, negligence, closure or insolvency of a Sponsor, except that we will substitute a prize under clause 6.7;
(b) we are not liable for any loss arising from your inability to enter, play, connect, receive a notification, claim or redeem, caused by your device, software, network, carrier, location or settings, or by a third-party platform;
(c) we are not liable for the unavailability, delay, error or failure of the drand beacon, the OpenTimestamps calendars, the Bitcoin network or any relay, except that clause 9 applies;
(d) we are not liable for any loss of profit, opportunity, goodwill or data, or for any indirect, consequential, special or exemplary loss; and
(e) our total liability to any entrant in connection with a Draw or a prize is limited to the stated value of the relevant prize, or to providing a substitute prize under clause 6.7.
16.3 The exclusions and limits in clause 16.2 do not apply to liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot be limited by law.
16.4 Each Sponsor may rely on clause 6.4, clause 16 and clause 17 as if it were a party to these terms, under subpart 1 of Part 2 of the Contract and Commercial Law Act 2017. This does not reduce a Sponsor's own obligations as supplier of its prize.
16.5 By entering, you agree to compensate us and the relevant Sponsor for reasonable direct loss caused by your fraud or your breach of clause 13.1, as set out in clause 16 of the Terms of Use.

17. What "verifiable" means
17.1 We describe the draws as publicly verifiable. That means, and means only, that:
(a) the sealed entry list's Merkle root, entry count, prize order and target beacon round are published and signed before the beacon round exists, and are submitted for public timestamping;
(b) the beacon round and its signature are public and can be independently verified against the beacon's public key;
(c) the selection code is open source, deterministic and published, and anyone can re-run it in their browser against the published commitment and round to confirm the published winners follow from them; and
(d) any entrant can confirm, using their private proof, that their entries were included in the sealed list.
17.2 Verification checks that the published result follows from the published inputs. It does not, and we do not claim that it does, prove that every entry in the sealed list was eligible (eligibility is decided under clause 13 and voided entries are redrawn and published), prove the Bitcoin anchor existed before the Draw (clause 7.4), or guarantee the operation of any third-party service. We do not describe any draw as "tamper-proof" or "impossible to rig", and no statement by us or by Shona should be read that way.
17.3 We use approved public wording for the draw: every entry list is sealed and published before the draw, then permanently anchored on the Bitcoin blockchain; winners are picked using the League of Entropy public randomness beacon; anyone can check any draw.
Note for the lawyer: please confirm this wording, and clauses 7, 8, 9 and 17, are accurate and substantiated for the purposes of sections 9, 12A and 13 of the Fair Trading Act 1986, given that the Bitcoin confirmation arrives after the draw.
18. Cancellation, postponement and events outside our control
18.1 We may cancel, postpone or suspend a Draw, or the Live Game for a Draw, only where it is necessary because of an event outside our reasonable control (including failure of hosting, telecommunications or third-party services, a cyber attack, a natural disaster, an epidemic, a government direction or an emergency), because the law requires it, or because fraud or a technical fault has compromised the integrity of the Draw in a way that clause 9 cannot cure.
18.2 If a Draw has been sealed and committed, it is not cancelled: the Draw proceeds under clause 9 when it can.
18.3 If a Draw is cancelled before the seal, entries earned for it are carried into the next Draw for that region, prizes listed for it are carried into that next Draw (unless a Sponsor's prize expiry makes that impossible, in which case the Sponsor's prize is replaced under clause 6.7), and we publish the cancellation and the reason.
18.4 If the Live Game for a Draw cannot run, the Draw still runs on Anytime Quiz entries and any entries recorded from the part of the Live Game that did run, and we publish that. Where a Live Game is cut short by a failure in our systems, we may, if the Schedule for the next Draw so states, add an additional free entry for every player who was connected at the time of the failure, applied equally to all of them.
18.5 We are not liable to you for a cancellation, postponement or suspension under this clause, to the maximum extent permitted by law.
19. Changes to these terms
19.1 We may change these Competition Terms for future Draws. A change takes effect only for Draws that open after the change is published, and we will give at least 7 days' notice on the site of any change that materially affects entrants, unless the change is required sooner by law or to prevent fraud.
19.2 Once a Draw has opened, the Competition Terms and the Schedule that applied at its opening are frozen for that Draw. We do not change the prizes, the entry rules, the draw method, the beacon round rule, the claim window or the eligibility rules for a Draw after it opens, except that an unlock prize listed in the Schedule may be added when its condition is met (clause 6.2) and a prize may be substituted under clause 6.7.
19.3 Each Schedule states the version and date of the Competition Terms that apply to it. Previous versions are available on request.
20. Complaints, disputes and governing law
20.1 If you think a Draw was not run according to these terms, or you have any other complaint, contact us at [contact email] within 14 days of the Draw. Tell us what happened and give us the draw identifier. We will acknowledge your complaint within 2 working days and aim to respond within 10 working days. We will correct any error in the published record under clause 9.2.
20.2 These Competition Terms are governed by New Zealand law and you and we submit to the non-exclusive jurisdiction of the New Zealand courts. Nothing in this clause prevents you from taking a claim to the Disputes Tribunal, or from complaining to the Commerce Commission, the Department of Internal Affairs (Gambling Compliance) or any other regulator.
21. Third-party platforms
21.1 Google, Meta Platforms (Facebook and Instagram), X, Apple, app stores and mobile carriers are not sponsors, administrators or endorsers of any My Shout Draw and have no involvement in it. Questions and complaints go to us.
21.2 Any My Shout promotion that appears on Facebook or Instagram is in no way sponsored, endorsed or administered by, or associated with, Meta Platforms, Inc. or its affiliates. Entrants provide their information to NetPotential Limited, not to Meta, and release Meta from all liability in connection with the promotion. No Draw requires or rewards sharing, tagging, liking, following or posting on any social platform.
